TERMS OF USE | FEDERATION OF WOMEN ENTREPRENEURS - KENYA

Terms of Use

The rules, standards, and legal boundaries governing the use of the FOWEK platform and digital ecosystem. Last updated: 23 September 2026.

1. Who we are

This website is owned and operated by the Federation of Women Entrepreneurs – Kenya (FOWEK), a Trust registered in the Republic of Kenya, with offices at WuYi Plaza, Off Galana Road, Nairobi, Kenya.

In these terms, “FOWEK”, “we”, “us” and “our” mean the Federation of Women Entrepreneurs of Kenya. “You” and “your” refer to any individual, member, corporate representative, or visitor accessing or using this website.

2. Accepting these terms

By using this website, you confirm your unconditional agreement to comply with and be bound by these terms. If you do not agree with any part of these terms, you must immediately discontinue use of this site.

We may update these terms periodically to reflect statutory, operational, or technological changes. The date at the top of this page indicates the current version. Continued use of the platform after updates constitutes binding acceptance of the revised terms.

3. Who this website is for

This website is intended for individuals aged 18 years and above. FOWEK membership is open to adult women entrepreneurs, women investors, women business owners, and the organisations representing them.

We do not knowingly collect personal information from minors. If you have reason to believe a minor has submitted data through our digital channels, write to us at secretariat@fowek.org and we will purge the records immediately.

4. What you can do with our content

You may view, download, and print material from this website for personal business use, internal research, or to share informational materials about FOWEK with colleagues.

Express Restrictions: You may not:

  • Republish, sell, or commercially exploit our content without prior written licence.
  • Use FOWEK’s registered trade name, emblem, or logo in a manner suggesting endorsement or sponsorship of your enterprise, unless formally authorised in writing.
  • Copy, adapt, record, or resell proprietary training manuals, workshop curriculum, research reports, or programme materials.
  • Prohibition of Scraping: Extract data by automated means (including bots, crawlers, scrapers, or manual harvesting) to collect member directory listings, executive contacts, or telephone databases.

All materials on this site—including text, graphics, logos, video assets, and design frameworks—are the intellectual property of FOWEK or licensors. Nothing herein transfers intellectual property rights to you.

5. Conduct that is not allowed

You must not misuse our systems. You agree not to:

  • Gain unauthorised access to our server architecture, administrative accounts, or restricted databases.
  • Transmit malicious software, worms, trojans, ransomware, or corrupt payloads.
  • Impersonate FOWEK, our Board of Trustees, Secretariat staff, members, or institutional partners.
  • Send unsolicited commercial communications (spam) to members whose details were obtained via this platform.
  • Submit defamatory, harassing, discriminatory, or unlawful content through our forms.

Statutory Warning: Misuse of this nature constitutes a criminal offence under the Computer Misuse and Cybercrimes Act, 2018, covering unauthorised system interference, identity theft, cyber-harassment, and phishing. FOWEK reports infractions directly to the Directorate of Criminal Investigations (DCI) and competent law enforcement bodies.

6. Membership, events and payments

Applications for membership and event bookings are subject to additional contractual frameworks:

  • Membership onboarding is governed by our Membership Terms & Conditions.
  • Participation in symposiums and trade delegations is governed by our Event & Programme Terms.

Payment Authenticity Protocol: FOWEK collects membership fees, bazaar bookings, and sponsorship funds exclusively through official corporate bank details and paybill numbers published on the Membership portal of this website. If anyone contacts you requesting payment to a personal MPESA number, an unlisted bank account, or a personal till, do not pay. Contact our Secretariat immediately at +254 798 510 851 to verify legitimacy.

7. Links to other websites

This website links to external platforms, including government agencies, development partners, financial institutions, and regional bodies like COMFWB. These sites are outside our direct governance. An outbound link does not imply formal endorsement of third-party products, opinions, or data practices, and FOWEK assumes no liability for external website contents.

8. Information on this site

While we make reasonable efforts to keep information accurate, application deadlines change, fees adjust, and trade protocols evolve.

Not Professional Advice: Content published across this platform—including webinar recordings, summaries, financial guides, and market intelligence reports—is for general informational purposes only. It does not constitute legal, tax, investment, or regulatory advisory. You must obtain independent, professional counsel tailored to your specific commercial circumstances.

Opportunities shared regarding incubation grants, B2B procurement, or overseas trade missions represent opportunities to participate. They do not constitute a guarantee of selection, grant approval, or contractual award.

9. Availability of the site

We strive to maintain continuous uptime, but do not warrant that site functions will be uninterrupted, error-free, or entirely devoid of latency. We reserve the right to suspend or restrict server access for operational maintenance, updates, or events of force majeure without liability.

10. Our liability

To the fullest extent permissible under Kenyan law, FOWEK, its trustees, officers, and secretariat employees will not be liable for any indirect, consequential, or economic loss—including loss of profits, commercial revenue, anticipated savings, or business reputation—arising out of your use of or reliance upon this platform.

Nothing in these terms limits liability that cannot lawfully be disclaimed under the laws of Kenya.

11. Governing law and disputes

These terms and any non-contractual obligations arising from them are governed exclusively by the Laws of the Republic of Kenya.

Dispute Resolution: If an issue arises, the parties will first seek an amicable solution in writing via secretariat@fowek.org. If the matter is not resolved within thirty (30) days, either party may refer the dispute to mediation in Nairobi under the Nairobi Centre for International Arbitration (NCIA) rules, prior to initiating court proceedings. The courts of Kenya retain jurisdiction over matters remaining unresolved.
